Failure of Authorities to Protect Human Rights Defender Mr. Ferdin Rayan

Mr. Ferdin Rayan, a dedicated human rights defender, has been instrumental in addressing significant social issues through his public interest work. His use of the RTI Act and legal battles have led to the suspension of toll fees at the Vagaikulam toll gate, the removal of illegal constructions in Tirunelveli, and improvements in fire and safety standards for public buildings. His advocacy for proper approvals for public infrastructure, environmental preservation, and opposition to illegal activities like medical waste dumping and fraudulent land acquisitions have significantly benefited public welfare. Rayan has also championed the causes of marginalized communities, raising concerns about the impact of NEET exams on student mental health, injustices faced by fishermen, and environmental threats from thermal power plants. During the pandemic, his humanitarian efforts supported vulnerable groups and frontline workers.

Despite his contributions, Mr. Rayan has faced threats due to his activism. On October 16, 2023, he requested armed police protection from the District Collector and the Commissioner of Police in Tirunelveli. After receiving no response, he sought protection from the Madras High Court, which directed local police to address his petition. However, no protection was provided.

On May 4, 2024, Mr. Rayan was brutally attacked by unknown individuals with machetes near the Police Commissioner's office in Tirunelveli. Despite severe injuries, he managed to drive to safety and was later hospitalized. Due to ongoing threats, his parents transferred him to a hospital in Thiruvananthapuram.

A complaint was registered under section 307 of the IPC, and on May 7, 2024, Mr. Rayan received a summons related to a toy air pistol purchase. We believes this attack is a direct reprisal for his activism and highlights the negligence of district administration and police in failing to provide him with protection despite repeated requests and court orders.

The failure to protect Mr. Rayan raises serious concerns about the commitment of local authorities to safeguard human rights defenders. We urge the Hon’ble Commission to take cognizance of the above case and urgently:

  • Direct the Director General of Investigation of the NHRC to initiate a transparent, independent inquiry in the attack against the HRDs and submit the report to NHRC within two Weeks.
  • Direct the Director General of Police of Tamil Nadu to produce within 48 hours copies of all relevant documents pertaining to the summons for an independent examination by the Hon’ble Commission.
