Fabricated FIR on Rajesh Kundu a journalist in Hisar for posting an alert message on Facebook and WhatsApp

HRDA has issued an urgent appeal to the National Human Rights Commission of India on May 24, 2021, regarding fabricated FIR on journalist in Hisar for posting an alert on Facebook and WhatsApp. Mr. Kundu is a journalist based out of Hisar and runs a news portal The Ink” and has been covering the ongoing farmers protest extensively. 

Mr. Kundu on April 08, 2021 posted an alert message on his Facebook timeline as well as WhatsApp groups where he wrote about the possibilities of inter-caste riots in Hisar on Ambedkar Jayanti. He claimed in the message that it was based on his sources. 

A FIR was registered against him on April 9, 2021 by the police in the Civil Lines police station, Hisar. He was charged under sections 153-A, 153-B of the IPC and section 66F of the IT Act. In the FIR, he was accused of spreading enmity among various groups and making statements prejudicial to national integration and cyber terrorism. 

Mr. Kundu was merely doing his duty as a journalist and the FIR filed against him violates his rights to freedom of speech and expression guaranteed under Article 19 of Indian Constitution. It also violates the UN Declaration on Human Rights Defender which protects monitoring and advocacy functions of defenders by their right to collect and disseminate information for the enjoyment of human rights.
