Arrest of journalist Mr. Jaspal Singh by Haryana police for a social media post with MLA name

Journalist Mr. Jaspal Singh was arrested by Haryana police on March 18, 2023, based on an FIR filed by the son of a local MLA, alleging defamation through a social media post related to a gambling case. The arrest involved charges under various sections, including those from the Indian Penal Code and Information Technology Act.

The FIR includes charges that may impede freedom of speech, expression, and the right to information, violating the principles crucial to journalistic work. Additionally, the wrongful application of the SC/ST PoA Act is highlighted, as Mr. Singh made no caste-based insult. The arrest of Mr. Jaspal Singh is seen as an attack on journalism, with concerns raised about the abuse of Article 19(b) and Article 21 of the Indian Constitution.

HRDA- India appeals to the NHRC to:

  1. Direct the Director General of Police of Haryana to dismiss false charges against Mr. Jaspal Singh.
  2. Initiate an independent, thorough inquiry into the arrest, submitting a transparent report to the NHRC.
  3. Ensure the physical security of Mr. Jaspal Singh and his family, preventing further harassment by the police.
