The recent events in Nainital, Uttarakhand, involving the anti-encroachment campaign and subsequent violence demand immediate attention. Following the demolition of a mosque and a school in the Banbhoolpoora area of Haldwani on February 8, 2024, protests erupted as locals contested the lack of prior notice from the administration, citing a court stay order. The situation escalated as police resorted to force, resulting in six fatalities and injuring over 250 individuals. Subsequently, a curfew was imposed, and internet services were suspended, while reports emerged of police misconduct, including alleged assaults on residents and unwarranted entries into homes. This egregious violation of human rights, marked by excessive use of force and disregard for due process, warrants immediate investigation and accountability measures.
The actions of the local administration and police in Uttarakhand represent a flagrant breach of constitutional and international standards. The use of disproportionate force against unarmed protestors, resulting in loss of life and injury, contradicts principles enshrined in the Indian Constitution and international human rights instruments. Moreover, such actions undermine the fundamental right to peaceful assembly and expression, as outlined in various legal frameworks. HRDA appeal to NHRC for Urgent intervention which is imperative to uphold the rule of law, ensure accountability for the victims, and prevent further violations. Therefore, a swift and impartial inquiry, conducted under the auspices of the NHRC's investigation wing, is essential to address the gravity of this incident and safeguard fundamental rights in Nainital and beyond.
