Misuse of law and demand for bribe from WHRD by Bihar police officials.

Bihar police officials, led by Inspector Mr. Rakesh Kumar, are accused of misusing the law and demanding a bribe from Women Human Rights Defender (WHRD) Ms. Sanju Devi. The police allegedly ignored Ms. Devi's assault complaint and later pressured her to withdraw it. Furthermore, they demanded a bribe of Rs. 40,000 for pursuing the case against her assailants.

The incident raises concerns about the misuse of law, threats, and bribery, constituting a gross violation of Ms. Sanju Devi's fundamental right to life and personal liberty under Article 21 of the Indian Constitution. The actions also contravene national and international human rights protections for human rights defenders, as outlined in the UN Declaration on human rights defenders.

HRDA urges the NHRC to :

  1. Direct the Director General of Police of Bihar to conduct an immediate, independent, and impartial investigation into the misuse of law by Mr. Rakesh Kumar and other police personnel against WHRD Ms. Sanju Devi. A comprehensive report is to be submitted to the NHRC within 4 weeks.
  2. Direct an investigation into the criminal misconduct by Mr. Rakesh Kumar for demanding a bribe, as per the Prevention of Corruption Act. Submit a report on this matter to the NHRC within 4 weeks.
  3. Based on investigation results, recommend strict punitive action against Mr. Rakesh Kumar and other involved police officials who misused their powers and demanded a bribe from Ms. Sanju Devi.
  4. Direct the Director General of Police of Bihar to urgently address FIR (334/2022) against Mr. Dheeraj Thakur and others, ensuring the immediate arrest of the accused.
  5. Ensure complete security for Ms. Sanju Devi to prevent further harassment by both goons and police officials.

The appeal urges the National Human Rights Commission to intervene promptly and address the serious allegations of reprisal against a human rights defender, emphasising the need for accountability and protection of Ms. Sanju Devi's rights.
