Illegal detention and arrest of HRD Kamlesh Yadav under fabricated charges by Bihar Police

Mr. Kamlesh Yadav is an activist based in Jagdishpur in Bhojpur district of Bihar and a state committee member of the All India Students Association. He has organised and participated in numerous peaceful agitations, rallies and programmes on students’ issues, corruption, rights and entitlements of poor, marginalised sections of society and relief work during the COVID-19 pandemic. 

HRDA issued an urgent appeal to the National Human Rights Commission of India on June 1, 2022, over the fabricated cases, illegal detention, and illegal arrest of Mr. Yadav by the Bihar police. 

A team of 15-20 uniformed police officials surrounded Mr. Yadav’s house on April 28, 2022 and forced him to come with them to Jagdishpur police station, where he was detained overnight in the lockup without a detention memo. He was not provided access to a lawyer and was handcuffed while being taken from the police station to Ara Court and again from the Court to Ara jail. 

The police flouted a plethora of arrest guidelines laid down under the DK Basu judgement and key Supreme Court orders with regards to handcuffing. 

We urged the Hon’ble Commission to direct the Director General of Police, Bihar, to initiate an independent inquiry into the illegal detention and arrest of Mr. Yadav.
