Abduction and illegal detention of HRD Advocate by Aminabad Police

On May 7, 2023, 75-year-old HRD Advocate Mohammad Shoaib, a prominent human rights lawyer in Uttar Pradesh, was illegally detained by 10 individuals, including police personnel from Anti Terrorism Squad (ATS) Uttar Pradesh and Lucknow. Despite his wife's concerns about his health, he was taken to the ATS headquarters instead of the Aminabad police station, where he was questioned about his association with PFI (Popular Front of India) and pressured to disband his NGO, Rihai Manch. The ATS violated DK Basu Guidelines, failing to provide accurate identification, inform family promptly, disclose arrest details, and allow legal representation during interrogation. Mohammad Shoaib's detention, marked by deception and rights violations, is deemed an abduction by the Uttar Pradesh police.

HRDA urgently requested NHRC to initiate an independent inquiry by the NHRC's Director General of Investigation into HRD Advocate Mohammad Shoaib's kidnapping and DK Basu guidelines violations, with a report submission in four weeks. And it is requested to direct the Director General of Police in Uttar Pradesh to promptly take action against police personnel involved in the illegal detention of Mr. Shoaib.
